Appellate Div Presiding Justice Beldock says he will start inquiry into circumstances under which Sup Ct Justice Cromarty signed ct order clearing title to parcel of land for corp in which he was partner, Babylon; disclosures made by LI newspaper Newsday; Newsday says that Cromarty held 'secret and substantial interest' in real estate syndicate that has made big profits in real estate ventures within Town of Babylon; says syndicate's landholdings soared in value as result of 6 rezonings granted over 7-yr period; Suffolk County Dist Atty Aspland seizes records of 2 of corps named in Newsday article, Frontier Park Inc and Broad Hollow Manor Inc; says records were seized after citizen of Babylon complained of 'wrongdoing by pol and pub figures in Babylon'; says records will be investigated to see if there is sufficient reason to present them to grand jury; refuses to name persons involved in 2 corps; Newsday identifies them as Cromarty, Babylon Repub chmn F Fellman, R Fellman, E Blumberg and W Gibbons; names pub and party posts held by Cromarty during 7 yrs that corps in which he had interest sought rezonings and changes in variances on properties in Babylon; alleges that Cromarty and others never divulged to pub that they were partners in corps that built extensive trailer pk and 96-unit garden development and speculated in land for industrial use in N Amityville; says that Cromarty signed ct order in Aug '68 that cleared way for Frontier Park Inc, in which he had 30% interest, to purchase land in N Amityville; Blumberg defends action; denies conflict of interest on Cromarty's part
