Abbott Labs and 5 Indicted in Fluids Sale

Abbott Laboratories Inc and 5 of its present or former officers on May 29 are indicted by Fed grand jury in case involving sale of allegedly contaminated intravenous fluids in 70 and '71; deaths of 50 persons and illnesses of 12 others were found by Fed health authorities to be traceable to contaminated fluids from improperly sealed containers; Abbott has been charged with violations of law in connection with production of intravenous fluids in '64 and '69, but was not previously subject to criminal prosecution; co says it is 'most disappointed' with Justice Dept's decision to go ahead with criminal prosecution in latest case; also protests that none of its accused officials had been given opportunity to defend their actions during course of the investigation conducted by FDA; notes that allegedly contaminated fluids were recalled in '71 and that case is not related to current or future operations of the business; all of the contaminated vaccine was made in co's plant in Rocky Mount, NC, which was closed by FDA; indictment covers 30 different batches of several different types of solutions; co and each individual defendant were named in each of 60 counts of indictment, count of 'adulteration' and count of 'misbranding' for each of 30 batches; maximum penalty upon conviction is fine of $1,000 for each count; maximum penalty upon conviction of each official is 1 yr in jail and fine of $1,000 for each count; defendants are H M Gross, C J Endicott, R T O'Donnell, R H Otto and H W Howell; O'Donnell is no longer with co
