Fed Judge Gerhard Gesell in White House plumbers case on May 24 rules that Pres Nixon has no const right to authorize break‐in and search without warrant even when natl security and foreign intelligence are involved; declares that 4th Amendment protects privacy of citizens against unreasonable and unrestrained intrusion by Govt officials and their agents; says that defendants are not entitled to cite ‘national security’ as legal justification for their participation in break‐in at office of Daniel Ellsberg's former psychiatrist Dr Lewis J Fielding; legal experts note that Gesell's ruling on 4th Amendment, if upheld, could be landmark in that it places specific prohibition on powers of Pres in foreign affairs; Gesell rules that defendants can subpoena specific natl security documents that will directly aid their defense and also show their knowledge and authority in such areas; warns that if such materials are refused by Nixon Adm, ct will use full range of its sanctions to insure that defendants receive fair trial
