PROSECUTOR SAYS HIS WITNESS HID A KEY HUNT MEMO

Watergate cover-up chief prosecutor James F Neal discloses on Nov 4 that E Howard Hunt Jr withheld until last weekend a 'bombshell document' that affects all 5 defendants; document is memo Hunt wrote on Nov 14 '72 reminding Nixon re-election campaign and White House officials of their alleged 'commitments' of money and pardons in return for defendants' silence about Watergate break-in at Dem Natl Com hq on June 17 '72; Hunt described such a memo in his testimony last wk and said that he had prepared it for his atty, William O Bittman, for submission to Kenneth W Parkinson, then an atty for Nixon re-election campaign and now a cover-up defendant; Hunt said he did not know where memo was and Bittman denied its existence; Neal says Bittman admitted receiving memo and had turned over a copy; says Govt's initial 'prosecutorial decisions' in case were affected by statements that Bittman had made to Govt in past; says Govt and defense were misled by Bittman and calls it 'sad affair'; Parkinson's atty Jacob A Stein requests severance and mistrial for Parkinson; says he feels he is now confronted with a 'cover-up within a cover-up'; Judge John J Sirica postpones decision; denies mistrial motion by H R Haldeman's atty John J Wilson; document, which Hunt purportedly wrote on behalf of all 7 defendants, lists variety of 'items for consideration'; among them is contention that ex-Atty Gen J N Mitchell may have committed perjury and fact that Watergate break-in was 'only of a number of highly illegal conspiracies engaged in by 1 or more of the defendants at the behest of sr White House officials'; says defendants kept 'their part of the bargain by maintaining silence' but 'Adm, however, remains deficient in living up to its commitments'; implications of disclosure for Bittman noted; Neal's account to ct of how document was turned over to prosecution noted; Neal says prosecution will not call Bittman as witness as it had intended; asst prosecutor Richard Ben-Veniste says Bittman told prosecution he had given 'acctgs' to Parkinson, presumably of money that Hunt and others were demanding and receiving in mos following Watergate break-in; prosecution is standing by this; prosecution and Stein say Bittman is still contending that he never transmitted Hunt memo to Parkinson; Jeb S Magruder, under cross-examination by Robert C Mardian's atty Thomas C Green, testifies that when he told Mardian on June 17 '72 of bungling that had led to arrest of Watergate burglars, Mardian said that 'if he had been in charge there wouldn't have been this kind of amateurism'; Neal reads to jury testimony that Parkinson gave before grand jury about shredding notes he made of conversation on July 13 '72 with Magruder; in that conversation, Magruder told him what he contended was true story of Watergate, implicating himself and Mitchell; jury hears testimony from Robert A F Reisner, formerly adm asst to Magruder at election com (L)
